While Altman speaks about respecting creative work and developing new models for compensation, OpenAI is simultaneously arguing in court cases that their use of copyrighted material for training should be protected as “fair use” under copyright law. This position contrasts with his statements about respecting creators’ rights.

The disconnect between Altman’s public comments about protecting creative work and OpenAI’s legal arguments defending their training practices represents a significant tension in their approach to copyright. Many creators feel that regardless of how the generated output is handled, the initial training on their work without permission or compensation is itself problematic.  His forked public postures are disconcerting for a company that 10% of the population is using and is a position to move men to action though usage.
